Traffic Citations

 If you have received a traffic citation, please be advised that the judge will not reduce, amend or dismiss any charge, with the exception of violations for no driver’s license, no proof of insurance, no registration, or other violations that can be cleared by providing proof to the Court.  When you receive a citation, there will be an appearance date and time listed on the ticket.  You must appear in person or contact the Court by telephone, by that date and time, to admit guilt or to contest the charges listed on the citation.  If you fail to appear and you fail to contact the Court, a bench warrant will be issued for your arrest, adding an additional amount of $285 to the amount noted on the citation.  The DMV will also be notified of your failure to appear.

 

When a citation states that you must appear in Court, rather than listing a fine or bail amount, it is a mandatory appearance on the date and time listed on the citation.  YOU MUST APPEAR PERSONALLY.

 

If you cannot afford to pay the entire amount listed on the citation, please contact the Court to arrange a payment plan.  Once a plan is established, if you default in your payments, a bench warrant may be issued.

 

If you wish to contest the citation, a date for trial will be scheduled.   At trial you will have the opportunity to present evidence and testify in your defense if you wish to do so.  You do not have to present a defense.  It is the burden of the State to prove beyond a reasonable doubt that you are guilty of the violation on the citation.  If you wish to contest the citation and have a trial, you must post the total amount for bail and fees listed on the citation before a trial will be scheduled.  If you are found not guilty at trial, the amount you have posted will be refunded to you.  If you are found guilty at trial, the amount you have posted will be forfeited toward payment of the citation.

 

Attendance at traffic school is NOT allowed in lieu of a conviction on your driving record.  If a Nevada licensed driver attends traffic school, he/she may receive credit by the Nevada DMV for a 3-demerit reduction on their driver’s license.  However, the conviction will remain on the driving record for a period of one year, unless the violation is such that Nevada law requires it to remain on the driving record for a longer period of time.

The Court accepts payments in the following forms: 

• Money Order
• Cashier’s Check
• Credit or Debit Card – a convenience fee is charged
• Cash, when paying in person – do not send cash through the mail 

 

After Hours and Weekends:  Payments can be made by putting your payment in the drop box located at the front door at Carlin City Hall.  Include your name and case or citation number to make sure the payment gets credited to the correct case.  It is advisable that you call the Court the next business day to make sure your payment was received.
