The Board of County Commissioners, County of Elko, State of Nevada, will meet in regular session on Wednesday, March 21, 2012 at 1:30 p.m. in Suite 102 of the Nannini Administration Building, 540 Court Street, Elko, Nevada.  All times Pacific Time.

 

Attached with this Notice is the Agenda for said meeting of the Board.
This Notice is posted pursuant to N.R.S. 241 as amended by the 2011 Legislature.

Public Hearing by the Nevada State Department Of Health And Human Services – Division of Health to accept public comment on a certificate of need request by Elko Health Care, LLC to construct a 34-bed addition to the Highland Manor of Elko, bringing the total licensed capacity to 146 beds and all other matters related, thereto.

Discussion and consideration of approval for the Trustee Property Auction /Sale on May 11, 2012 and all other matters related, thereto.

 

 IV. --  USFS MOUNTAIN CITY, RUBY MOUNTAINS AND JARBIDGE DISTRICT
          
TRAVEL MANAGEMENT PROJECT:                                   FOR POSSIBLE ACTION
Discussion and consideration of issues regarding the Mountain City, Ruby Mountains and Jarbidge District Travel Management Project FEIS/ROD including a briefing from Wendy Fuell, U.S. Forest Service, a review of the Congressional Hearing held on March 12, 2012 and the development of a resolution of joint support with other affected counties and organizations and all other matters related, thereto.

 

 V. -- US DEPARTMENT OF THE INTERIOR – BUREAU OF LAND MANAGEMENT:
        
Greater Sage-Grouse Interim Management Policies and Procedures Instruction
        
Memorandum (IM) No. 2012-043                                             FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Greater Sage-Grouse Interim Management Policies and Procedures IM including impacts to public lands management processes and operations including possible discussion regarding the impacts upon the China Mountain Wind Power Project, gas exploration leases and other public land management impacts and all other matters related, thereto.

 

 VI. --  ELKO COUNTY PLANNING AND ZONING DEPARTMENT:
          
Roadway Dedication for Parcel Map Request:                      FOR POSSIBLE ACTION
Discussion and consideration of a request for a roadway dedication for a parcel map for Jordanelle Third Mortgage on Hamilton Creek Trail and Hamilton Creek Court in Elko County, Nevada, located in Section 28, T34N, R55E, M.D.B.&M. and all other matters related, thereto.

 

VII. --  ELKO COUNTY DISTRICT ATTORNEY’S OFFICE:
          
Civil Legal Service Agreement:                                               FOR POSSIBLE ACTION
Discussion and consideration of approval of a Civil Legal Service Agreement to provide certain civil legal services for inmates at the Elko County Detention Facility and all other matters related, thereto.

 

VIII. --  ELKO COUNTY CODE:                                                     FOR POSSIBLE ACTIONS
           
Wind Resources Ordinance Repeal and Revision:
A. --    Discussion and consideration of the first reading of the repeal of Elko County Wind Resource Ordinance 2011-04, Bill D, entitled, AN ORDINANCE ADDING SECTION 15 TO TITLE 4, CHAPTER 8 OF THE ELKO COUNTY CODE  ALLOWING FOR THE DEVELOPMENT OF WIND RESOURCES IN THE VARIOUS ELKO COUNTY ZONING DISTRICTS; REVIEWING WIND RESOURCE DEVELOPMENT THROUGH THE USE OF CONDITIONAL USE PERMITS, AND MITIGATING POTENTIAL ADVERSE IMPACTS, AND ALL OTHER MATTERS RELATED THERETO.

B. --     Discussion and consideration of the first reading of Elko County Wind Resource Ordinance 2012-02, Bill B, which replaces Ordinance 2011-04 changing the minimum lot size to two and one half acres, entitled, AN ORDINANCE ADDING SECTION 15 TO TITLE 4, CHAPTER 8 OF THE ELKO COUNTY CODE ALLOWING FOR THE DEVELOPMENT OF WIND RESOURCES IN THE VARIOUS ELKO COUNTY ZONING DISTRICTS; REVIEWING WIND RESOURCE DEVELOPMENT THROUGH THE USE OF CONDITIONAL USE PERMITS, AND MITIGATING POTENTIAL ADVERSE IMPACTS, AND ALL OTHER MATTERS RELATED THERETO.

 

 IX. --  NEVADA CONSOLIDATED SALES TAX:                         FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Legislative Study Subcommittee to review the allocation of funds distributed from the Local Government Tax Distribution Account, including update on the March 15th meeting and all other matters related, thereto.

Assembly Bill 71 from the 2011 Legislative Session created an interim subcommittee to study the distribution formula to local governments of sales tax funds. Since these funds are a significant source of local government revenue, Elko County will follow the subcommittee’s work with interest.

 

 X. -- ELKO COUNTY FISCAL AFFAIRS:                                       FOR POSSIBLE ACTION
Discussion and consideration of a proposed Elko County Rehire Policy and all other matters related, thereto.

           

XI. --  ELKO COUNTY WATER RESOURCE ISSUES:                FOR POSSIBLE ACTION
Discussion and consideration of water resource management and water rights issues that may impact Elko County including possible discussion related to the Southern Nevada Water Authority pipeline project and the Central Nevada Regional Water Authority activities and issues and all other matters related, thereto.
