The Board of County Commissioners, County of Elko, State of Nevada, will meet  in regular session on Wednesday, June 20, 2012 at 10:00 a.m. in Suite 102 of the Nannini Administration Building, 540 Court Street, Elko, Nevada.  All times Pacific Time.

 Attached with this Notice is the Agenda for said meeting of the Board.
This Notice is posted pursuant to N.R.S. 241 as amended by the 2011 Legislature.

Discussion and consideration of approval of the 2012 Primary Election Canvass as compiled by the Elko County Clerk’s Office and all other matters related, thereto.

 

III. --  ELKO COUNTY PUBLIC WORKS DEPARTMENT:
          
Mountain City Sewer System:                                               FOR POSSIBLE ACTIONS

A. --     Discussion and consideration of authorization to apply for a NDEP grant for approximately $320,000 for NDEP required sewer lagoon improvements and all other matters related, thereto.

B. --     Elko County Code – Mountain City Sewer System:  Discussion and consideration of the first reading of revisions to County Code 9-9 that includes provisions to set sewer rates by resolution, a cross connection control program, operational procedures and all other matters related, thereto.

 

 IV. -- ELKO COUNTY TREASURER’S OFFICE:                     FOR POSSIBLE ACTIONS
          
FY 2012-2013 Tax Rate Approval:
         
Consideration of approval of Resolution 10-2012, entitled, A RESOLUTION TO LEVY TAX RATES FOR THE COUNTY OF ELKO, STATE OF NEVADA, FOR THE FISCAL YEAR BEGINNING JULY 1, 2012, PURSUANT TO N.R.S. 361.460 and all other matters related, thereto.

 

 V. -- ELKO COUNTY ASSESSOR’S OFFICE:                           FOR POSSIBLE ACTION
Discussion and consideration of approval of a joint agreement with the City of Elko to utilize Assessor Technical Fund monies to fund half of the expense to geocode Elko County road centerlines and all other matters related thereto.

 

VI. --  ELKO COUNTY LIQUOR BOARD:                                    FOR POSSIBLE ACTIONS

A. --     Discussion and consideration of approval of a Liquor License application for Aaron Taylor and Jeffery Watson doing business as Muley’s Bar and Family Grill in Spring Creek and all other matters related, thereto.

B. --     Discussion and consideration of approval of a Liquor License application for Peter Lusich and Sean Mowray doing business as The Watering Hole in Spring Creek and all other matters related, thereto.

C. --     Discussion and consideration of approval of a Liquor License application for William Watson doing business as Red’s Ranch in Lamoille and all other matters related, thereto.

D. --     Discussion and consideration of approval of a Liquor License application for Troy Wadsworth doing business as The Cowboy Saloon & Café in Montello and all other matters related, thereto.

 

 VII. --  ELKO COUNTY SHERIFF’S OFFICE:                                FOR POSSIBLE ACTION
Discussion and consideration of approval of a request for a “critical need designation” for the Undersheriff position in the Sheriff’s Department and all other matters related, thereto.

 

VIII. -- U.S. DEPARTMENT OF AGRICULTURE (USDA):
          
ANIMAL AND PLANT HEALTH INSPECTION SERVICE (APHIS):
Discussion and consideration of issues with representatives from the USDA-APHIS regarding a potential County Predator Control Program including discussion of possible grant funding processes such as the Heritage Trust Account Grant, permit requirements and all other matters related, thereto.                                                                                       FOR POSSIBLE ACTION

 

 IX -- GREATER SAGE-GROUSE MANAGEMENT ISSUE:        FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Greater Sage-Grouse management issue including the BLM Greater Sage-Grouse Interim Management Policies and Procedures Instructional Memorandum; the Governor’s Greater Sage-Grouse Advisory Committee; development of an Elko County Plan to manage Sage-Grouse including impacts to public lands management processes and operations, other possible public land management implications and all other matters related, thereto.

X. --  NEWMONT MINING CORPORATION
        
Elko Area Transit Service:                                                     FOR POSSIBLE ACTION
Discussion and consideration of acceptance and appreciation for a major donation to the Transit Service from Newmont Mining Corporation to assist in the cost of operation of the service and all other matters related, thereto.

 

 XI. – NEVADA ASSOCIATION OF COUNTIES (NACO):                               NON-ACTION
Discussion and consideration of issues related to the Nevada Association of Counties including a presentation by NACO Deputy Director, Wes Henderson, regarding Emergency Preparedness - Continuity of Local Government (COG) in Nevada and all other matters related, thereto.

 

 XII. -- NEVADA DEPARTMENT OF TRANSPORTATION (NDOT):   

2:00 p.m.   
Statewide Transportation Improvement Program
Annual Work Program – Short and Long Range Elements for Elko County
Presentation and discussion of the proposed NDOT Transportation System Projects (TSP) document and 2013 Annual Work Plan (AWP), followed by consideration of approval of the Project document, discussion of State Transportation Department issues and all other matters related, thereto.                                                                                     FOR POSSIBLE ACTION

 

XIII. --  WESTERN COUNTIES ALLIANCE:                                   FOR POSSIBLE ACTION
Discussion and consideration of public lands issues with Kenneth Brown, Western Counties Alliance Executive Director, including but not limited to geothermal payments, PILT, sage-grouse, grazing fees, land transfers, wild horse/burros, USFS Travel Management and all other matters related, thereto.

 

 XIV. --  NORTHEASTERN NEVADA REGIONAL RAILPORT:
             
Road Overlay Project:                                                        FOR POSSIBLE ACTION
Pursuant to Notice No. 17-2012, bids were received and opened on June 19, 2012.  Pursuant to bid review and tabulation results, consider awarding the bid to the lowest responsive/responsible bidder and all other matters related, thereto. This project will resurface the frontage road at the Railport for safety and high-volume, high-weight loads that will utilize the roadway.

 

XV. --  ELKO COUNTY PLANNING AND ZONING:                      FOR POSSIBLE ACTION    3:30 p.m.        
A. --     Public Hearing - Right of Way Vacation Request:       
In accordance with Public Notice 22-2012 conduct a Public Hearing for a right of way vacation request submitted by Lynn M. Barstow for the vacation of a portion of alleyway located adjacent to Lots 1 & 3 of Block 27 and Lot 6, Block 28 of Pleasant Valley Estates and all other matters related, thereto.

B. --     Public Hearing - Right of Way Vacation Request:        FOR POSSIBLE ACTION
In accordance with Public Notice 23-2012 conduct a Public Hearing for a right of way vacation request submitted by Alan James London for the vacation of a portion of Buck Horn Drive located adjacent to Lots 5 of  Block 28 in Pleasant Valley Estates and all other matters related, thereto.

 

XVI. -- BOARD OF COUNTY HIGHWAY COMMISSIONERS:
A. --     Comments by the General Public:                                                          NON-ACTION
Pursuant to N.R.S. 241.020,2(c)(3), this time is devoted to comments by the general public, if any, and discussion of those comments.  No action may be taken upon a matter raised under this item of the agenda until the matter itself has been specifically included on a successive agenda and identified to be an action item.

B. --     Gas Tax Increase Proposal Recommendation:                    FOR POSSIBLE ACTION
Initial discussion and consideration of a recommendation from the Elko County Roads Service Advisory Committee to increase the gas tax by 2 ½ cents for costs associated with road improvements and all other matters related, thereto.  An ordinance public hearing will be required before an increase can be enacted.

  C. --     Twin Bridges/ Smith Creek Road Land Relinquishment:  FOR POSSIBLE ACTION
Discussion and consideration of approval of  Resolution 09-2012 entitled Resolution Consenting To Relinquishment and Land Transfer Agreement that will give back to Elko County the right of ways and easements for the Twin Bridges located on County Road 716A since the Federal Bridge Replacement Projects are completed and all other matters related, thereto.

  D. --     General discussion of routine road maintenance issues for information and/or administrative direction purposes.                                                      FOR POSSIBLE ACTION

 

XVII. -- USFS MOUNTAIN CITY, RUBY MOUNTAINS AND JARBIDGE DISTRICT
TRAVEL MANAGEMENT PROJECT:                                             FOR POSSIBLE ACTION
Discussion and consideration of issues regarding the Mountain City, Ruby Mountains and Jarbidge District Travel Management Project ROD including the possible development of a resolution of joint support and the possible formation of an organization with other affected counties and tribal councils and all other matters related, thereto.

                       

XVIII. -- ELKO COUNTY WATER RESOURCE ISSUES:            FOR POSSIBLE ACTION
Discussion and consideration of water resource management and water rights issues that may impact Elko County including possible discussion related to the Southern Nevada Water Authority pipeline project and the Central Nevada Regional Water Authority activities and issues and all other matters related, thereto.

 

 XIX. -- FY 2011-2012 YEAR END BUDGET ADJUSTMENTS: FOR POSSIBLE ACTIONS 

A. --     Review and approval of fiscal year end department account analysis and proposed adjustment pursuant to NRS 354.598005 and all other matters related, thereto.

B. --     Review of Elko County Contingency Account and amounts allocated y-t-d and those amounts proposed for year-end adjustments and all other matters related, thereto.

C. --     Review and approval of Resolution 12-2012 entitled: A RESOLUTION PROVIDING FOR THE TRANSFER OF APPROPRIATIONS FROM THE CONTINGENCY ACCOUNT WITHIN THE 2011/2012 FISCAL BUDGET FOR THE COUNTY OF ELKO GENERAL FUND and all other matters related, thereto.

D. --     Review and approval of Resolution 11-2012 entitled, A RESOLUTION PROVIDING FOR THE TRANSFER OF APPROPRIATIONS AND CASH FROM THE CONTINGENCY ACCOUNT WITHIN THE 2011/2012 FISCAL BUDGET FOR ELKO COUNTY GENERAL FUND TO THE ELKO COUNTY SOLID WASTE FUND and all other matters related, thereto.

E. --     Review and approval of Resolution 13-2012 entitled, A RESOLUTION PROVIDING FOR THE TRANSFER OF APPROPRIATIONS AND CASH FROM THE CONTINGENCY ACCOUNT WITHIN THE 2011/2012 FISCAL BUDGET FOR ELKO COUNTY GENERAL FUND TO THE NORTHEASTERN NEVADA REGIONAL FUND and all other matters related, thereto.

F. --     Discussion and consideration of approval of the Indebtedness Report, Capital Improvement Plan and the Annual Report for FY 2012 and all other matters related, thereto.

G. --     Review and approval of Resolution 14-2012 entitled, A RESOLUTION TO AUGMENT THE 2011-2012 BUDGET OF ELKO COUNTY that makes adjustments due to charges from the State to Elko County for services in the State Budget and all other matters related, thereto.

 

XX. -- NEVADA CONSOLIDATED SALES TAX:                        FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Legislative Study Subcommittee to review the allocation of funds distributed from the Local Government Tax Distribution Account including a report from the June 18, 2012 Subcommittee Meeting and all other matters related, thereto.
