The Board of County Commissioners, County of Elko, State of Nevada, will meet in regular session on Wednesday, July 11, 2012 at 1:30 p.m. and Thursday, July 12, 2012 at 1:30 p.m. in Suite 102 of the Nannini Administration Building, 540 Court Street, Elko, Nevada.  All times Pacific Time.

 

Attached with this Notice is the Agenda for said meeting of the Board.
This Notice is posted pursuant to N.R.S. 241 as amended by the 2011 Legislature.

Discussion and consideration of approval of Resolution 17-2012 congratulating Rural Nevada Development Corporation on twenty years of service to rural Nevada Communities and all other matters related, thereto.

 

 V. --  ELKO COUNTY CODE:
         
Gas Tax Increase Proposal:                                               FOR POSSIBLE ACTION
Discussion and consideration of the first reading of revision to County Code Section 6-10-2, Ordinance 2012-09, entitled, AN ORDINANCE RAISING THE ELKO COUNTY MOTOR VEHICLE FUEL TAX ELKO COUNTY CODE SECTION 6-10-2, FROM SIX AND ONE-HALF CENTS ($.065) PER GALLON TO A TOTAL OF NINE CENTS ($.09) PER GALLON, AND ALL OTHER MATTERS PROPERLY RELATED THERETO, that includes provisions to increase the gas tax by 2 ½ cents and all other matters related, thereto.

 VIII. -- GREATER SAGE-GROUSE MANAGEMENT ISSUE:    FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Greater Sage-Grouse management issue including an update from Kent McAdoo, a member of the Governor’s Greater Sage-Grouse Advisory Committee; the BLM Greater Sage-Grouse Interim Management Policies and Procedures Instructional Memorandum; development of an Elko County Plan to manage Sage-Grouse including impacts to public lands management processes and operations, other possible public land management implications and all other matters related, thereto.

 

 IX. --  USFS MOUNTAIN CITY, RUBY MOUNTAINS AND JARBIDGE DISTRICT
           
TRAVEL MANAGEMENT PROJECT:                                 FOR POSSIBLE ACTION
Discussion and consideration of issues regarding the Mountain City, Ruby Mountains and Jarbidge District Travel Management Project ROD including the possible development of a resolution of joint support and the possible formation of an organization with other affected counties and tribal councils and all other matters related, thereto.

 

 X. --  ELKO COUNTY PLANNING AND ZONING DEPARTMENT:

A. --      Public Hearing - Right of Way Vacation Request:        FOR POSSIBLE ACTION
In accordance with Public Notice 26-2012 conduct a Public Hearing for a right of way vacation request submitted by 3Bits, LLC for the vacation of a portion of public right-of-way on River Street in Jarbidge, Nevada, and all other matters related, thereto.

The vacation is further described as follows: Portions of River Street adjacent to Lots 1, 2 & 3 of Block 36 as shown on the official map of Jarbidge on file in the office of the Elko County Recorder, Elko Nevada numbered as file No. 31210.   Said portion is approximately 0.121 acres located within Section 16, T.46N., R.58 E., M.D.B&M., Elko County, Nevada.  The owner of said land is Elko County.

B. --     Parcel Map Dedication Request:                                          FOR POSSIBLE ACTION
Discussion and consideration of approval of a Parcel Map Dedication Request for Jordanelle Third Mortgage, LLC to dedicate 1.585 acres to Elko County and all other matters related, thereto.

 

XI. --  ELKO COUNTY PLANNING AND ZONING COMMISSION APPEAL:

Khoury Leasing, LLC – Barrick Parking Lot:                           FOR POSSIBLE ACTION
In accordance with Notice 25-2012 and Elko County Code 4-9-10, conduct an appeal hearing of the Elko County Planning and Zoning Commission denial of a proposed parking lot described as:    A parcel of land located in Section 33, T.34N., R.56E., M.D.B&M, County of Elko, Nevada, being a portion of that parcel as shown on the Record of Survey for Khoury Leasing, LLC, on file in the Office of the Elko County Recorder, Elko, Nevada as file No. 640603.  The general location is the southwest corner of the intersection of SR 228 (Jiggs Highway) and SR 227 (Lamoille Highway), and all other matters related, thereto.

Pursuant to Elko County Code 4-9-10(E), the action of the Board of County Commissioners shall be: The County Commissioners may at the conclusion of the appeal hearing sustain, modify or overrule the action or decision appealed, or may refer the matter, or a portion thereof, back to the Elko County Planning Commission for further consideration.  The final order of theCountyCommissionerson an appeal shall be effective forthwith.

Discussion and consideration of authorization to apply for a Nevada Division of Environmental Protection (NDEP) grant for approximately $320,000 for NDEP required sewer lagoon improvements and all other matters related, thereto.

Discussion and consideration of approval of amendments to the County Treasurer tax roll to strike off tax amounts that are deemed uncollectible and all other matters related, thereto.

VI. --  COMMERCIAL DOGS OR CATS BREEDERS LEGISLATION:
A. --     Discussion and consideration of issues related to the implantation of SB 299 that requires local governments to adopt permit requirements for commercial breeders of dogs and cats and all other matters related, thereto.                                           FOR POSSIBLE ACTION

Senate Bill No. 299 - AN ACT relating to animals; requiring the board of county commissioners of each county and the governing body of each incorporated city to adopt an ordinance requiring commercial breeders of dogs or cats to obtain a permit to act as a breeder under certain circumstances; setting forth the requirements for the issuance of those permits; making various changes to the standards of care for dogs and cats; and providing other matters properly relating thereto.

B. --  Elko County Code:                                                                       FOR POSSIBLE ACTION
Discussion and consideration of the first reading of Ordinance 2012-10, entitled, AN ORDINANCE AMENDING TITLE 7, CHAPTER 2, SECTION 18(A) 3. OF THE ELKO COUNTY CODE TO CHANGE “AND” TO “OR” AND ALL OTHER MATTERS PROPERLY RELATED THERETO.  This section of code deals with animal treatment.

 

 VII. --  NEVADA DEPARTMENT OF TRANSPORTATION (NDOT):
           
800 MHz Radio System Interlocal Agreement:                      FOR POSSIBLE ACTION
Discussion and consideration of approval of an Interlocal agreement with NDOT for County utilization of the 800 MHz Radio System and all other matters related, thereto.

 

VIII. -- KNAPP TRUST FUND:                                                          FOR POSSIBLE ACTION
Discussion and consideration of the disposition of the Knapp Scholarship Trust Fund and all other matters related, thereto.

The Knapp Scholarship Trust Fund was set up many years ago and used for scholarships to students graduating from high schools in Elko County.  The Trust fund has run its course and the County is named remainder beneficiary.  Staff may recommend that the funds be rejected by the County and returned to District Court for Court direction on the proper disposition of the trust fund.

 

IX. -- NEVADA CONSOLIDATED SALES TAX:                          FOR POSSIBLE ACTION
Discussion and consideration of issues related to the Legislative Study Subcommittee to review the allocation of funds distributed from the Local Government Tax Distribution Account and all other matters related, thereto.

 

 X. -- OIL AND GAS MINERAL LEASE REQUEST ON COUNTY TRUSTEE PROPERTY:
Discussion and consideration of a request to lease mineral rights on County Trustee Property including the process to address the request and a possible resolution if approved by the Commission and all other matters related, thereto.                         FOR POSSIBLE ACTION
